The privacy of Club Mastercard by Real Hotels & Resorts Affiliates is very important to us.
Real Hotels and Resorts, Inc., (hereinafter “Real Hotels & Resorts”), in its capacity as responsible for the treatment of the Personal Data of its Affiliates, adopts the following Privacy Policy and Informed Consent of the Club Mastercard by Real Hotels & Resorts (hereinafter the “Policy”).
Through this Policy, we inform you about the aspects that you must know and authorize, in relation to the privacy of your data when using our Platform or using our Services. We have a Database in which we collect, process and store your Personal Information for exclusively domestic or internal purposes.
If you do not want Real Hotels & Resorts to collect, store, use or treat your information in the manner described in this Policy, you must not use the Club Mastercard by Real Hotels & Resorts Platform, or the services, benefits and / or products that through it are offered.
DEFINITIONS
Affiliate: Any Cardholder who joins the Club Mastercard by Real Hotels & Resorts and who uses the Platform Services through the APP, or through any other means that Real Hotels & Resorts establishes for these purposes.
Messaging Application: Any instant messaging application for smartphones, such as but not limited to WhatsApp, that Real Hotels & Resorts decides to use to contact Affiliates.
APP: The application for IOS and Android devices that Real Hotels & Resorts makes available to Affiliates, as a mechanism to access the Club Mastercard by Real Hotels & Resorts Platform.
Database: An ordered set of data of any nature, whatever the form or modality of its creation, organization or storage, which allows the data to be related to each other, as well as to carry out any type of treatment or transmission of these by its custodian.
Consent: Manifestation of the will of the owner of the data, through which the treatment of these is carried out.
Platform: It is the platform created by Real Hotels & Resorts, which will allow Affiliates to join the Club Mastercard by Real Hotels & Resorts program and make use of its different Services and benefits. This platform may be accessed through the APP and through any other mechanism that Real Hotels & Resorts may establish, at its sole discretion, for this purpose.
Cardholders: Mastercard Black and Double Black cardholders who join the Club Mastercard by Real Hotels & Resorts program through the Platform.
Personal Information or Personal Data: It is understood as “Personal Information” or “Personal Data”, the name of the Affiliate, surname, email, telephone, exact address, information on purchases, and / or any other personal information that can identify or make identifiable to the Affiliate, and that is required by Real Hotels & Resorts to the Affiliate for the purposes of providing the Services. Real Hotels & Resorts will only ask its Affiliates for the Personal Information necessary to provide the Services and will dispose of it appropriately if the Affiliate requests it.

Real Hotels & Resorts obtains or may obtain Affiliate information from the following sources:
Information that we receive from the Affiliate when filling out their Personal Information on the Platform or when delivering it directly to our officials through any official communication channel designated by Real Hotels & Resorts, today or in the future, for these purposes.
Information provided to Real Hotels & Resorts by business partners, with the due Consent granted by the Affiliate.
Information about transactions or procedures carried out through or using the Platform, or through the Affiliate’s interactions with our APP.
Information given in surveys conducted by Real Hotels & Resorts to our Affiliates.
PERSONAL DATA WE COLLECT
Real Hotels & Resorts collects Personal Information such as the name of the Affiliate, surname, email, telephone, exact address, information about purchases, and / or any other personal information that can identify or make the Affiliate identifiable, and that is required by Real Hotels & Resorts to the Affiliate for the purposes of providing the Services.
Real Hotels & Resorts will request from its Affiliates only the Personal Information necessary to satisfactorily provide the Services and will dispose of it appropriately if the Affiliate so requests. RIGHTS OF THE AFFILIATE IN RELATION TO THEIR PERSONAL DATA
The Affiliate, in their capacity as owner of their Personal Data, will have the following rights:
Right of Access: The Affiliate will have the right to obtain in a reasonable period of time the confirmation or not of the existence of their data in our Database. You may request to be informed about the data held by Real Hotels & Resorts, as well as about the use that has been given to your Personal Information, and the system, program, method or process used in the treatment of your data.

INFORMED CONSENT TO STORAGE AND USE OF INFORMATION
By registering as an Affiliate by any of our means or by accessing our APP as an Affiliate, you freely and expressly accept that your Personal Information is stored, consulted, and processed by Real Hotels & Resorts.
Unless specifically stated otherwise, all the data that Real Hotels & Resorts requests from you in the registration and / or management of benefits and / or use of the APP, are necessary to be able to register and / or use the Services that Real Hotels & Resorts offers. The Affiliate is authorized not to provide their PERSONAL DATA; However, this could imply that we will not be able to provide some or some of the required Services, due to their nature.
It is the responsibility of the Affiliate that the information is real, truthful, complete and updated at the time it is entered into the Real Hotels & Resorts Platform by any of the means provided for these purposes, such as our APP. The omission or inaccuracy in any of them could imply the impossibility that we can provide the requested Services and / or attend to your requests and will empower Real Hotels & Resorts to take actions such as but not limited to: not providing the required Services, or that the data provided by the Affiliate is removed from the database.
The data of the Affiliates will not be transferred, communicated or transferred to third parties except as indicated in this Privacy Policy and Informed Consent.
The Affiliate acknowledges its acceptance of this Policy, and expressly authorizes Real Hotels & Resorts to carry out any operation or set of operations through automated or manual procedures in relation to their Personal Data. Real Hotels & Resorts may collect, carry out records, organize, preserve, modify, extract, consult, use, process, transmit, transfer, collate, block, delete or destroy the Personal Information of the Affiliate in accordance with the provisions of this Politics.
The Affiliate authorizes that Personal Information be shared with third parties such as, but not limited to, business partners of the Club Mastercard by Real Hotels & Resorts program, payment processors, or others who must participate in the execution of the Services required by the Affiliate. in accordance with the provisions of the Terms and Conditions of the Club Mastercard by Real Hotels & Resorts program and the APP. These third parties will be required at least the same security standards that Real Hotels & Resorts follows.
Likewise, your Personal Information may be given to third parties by virtue of a possible negotiation or formalization of a merger, acquisition, financing, assignment or other similar transactions. In these cases, Real Hotels & Resorts will deliver only the information strictly necessary and in compliance with the applicable legal guidelines on the transfer of personal data.
The data that the Affiliate provides to Real Hotels & Resorts is collected for the following purposes: informative, contact, commercial prospecting, for statistics collection, for marketing, advertising, promotional, operation, maintenance, management and administration of our Services and attention to the Affiliate, and these activities may be carried out by Real Hotels & Resorts or its service provider, duly authorized for these purposes. The data transfer carried out in accordance with this informed consent will be carried out under security standards that guarantee the Affiliate and Real Hotels & Resorts that the information will be treated, processed and stored in accordance with the specific purposes of this informed consent.
In addition to the above, Personal Information may be shared under the following circumstances:

The information and data collected by Real Hotels & Resorts will be treated with absolute privacy, confidentiality and security.
The Affiliate, with the reading and express acceptance of this Privacy Policy and Informed Consent, in an informed, individualized, clear, precise, unequivocal, voluntary, free, and aware of the scope of what is accepted here, grants their informed consent for the treatment of your data according to what has been indicated here.
The Affiliate’s data may be updated by the Affiliate, through their profile in the APP or by email to clubMC.RHR@r-hr.com. The Affiliate is solely responsible for keeping their data up to date.
The treatment and storage of Personal Data by Real Hotels & Resorts will be valid for an indefinite term and if the Affiliate allows it.
As indicated in Section III. of this Policy, the Affiliate, at any time, may revoke their consent to the storage and processing of their Personal Information and may exercise their rights by sending an email to the Responsible at the following address: clubMC.RHR@r-hr.com.

COMMUNICATION WITH THE AFFILIATE
Any Affiliate who registers to use the Services of the Platform and / or who writes to us by email may receive communications from Real Hotels & Resorts, by this means or by any other means registered by the Affiliate. The Affiliate accepts that Real Hotels & Resorts may communicate by any means registered by the Affiliate: information about promotions, products, invitations to events, notifications about changes to this Privacy Policy and Informed Consent and / or the Club Terms and Conditions Mastercard by Real Hotels & Resorts, as well as any other information or formal notification that Real Hotels & Resorts needs to communicate to the Affiliate.

The Affiliate authorizes the receipt of emails and text messages through Messaging Applications, by Real Hotels & Resorts. However, this may be a reason to cancel the Affiliate Services, since, in order to provide the services, it is essential for Real Hotels & Resorts to be able to communicate with the Affiliate by any of the channels.
SAFETY ASPECTS
We are committed to protecting your Personal Information and we have adopted the appropriate technical and organizational measures to protect such information against any loss, alteration, access or misuse.
Real Hotels & Resorts informs you that your Personal Data is stored in a database owned by it, located on servers on Google Cloud Platform https://cloud.google.com/ and you are guaranteed the appropriate measures of a technical nature and structural to guarantee the integrity and security of the Personal Information provided in accordance with the current state of the art.
Real Hotels & Resorts has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the Affiliate communicates to Real Hotels & Resorts, without prejudice to informing them that the measures of Internet safety are not foolproof.
RELEASE OF LIABILITY
The Affiliate acknowledges and accepts that the use of the APP and technologies such as Messaging Applications, is always carried out under their entire risk and responsibility. Real Hotels & Resorts will not be responsible for the improper use that may be made of these means of communication and / or technologies.
Real Hotels & Resorts will not be liable for damages of any kind caused to the Affiliate’s electronic equipment (computer, telephone, tablet, or others) by viruses, worms or any other harmful element. The Affiliate acknowledges that the use of the Internet network supposes the assumption of a risk that its computer equipment may be affected by the elements mentioned above. For this purpose, the Affiliate is responsible, in any case, for the availability of adequate tools for the detection and elimination of harmful electronic programs that may pose a risk to their equipment.
Real Hotels & Resorts will not be responsible for the failure to perform its obligations when there is force majeure, fortuitous events or the entry into force of government legislation, regulations or restrictions of any other nature that prevent it from performing its obligations.
CHANGES IN THE PRIVACY POLICY
Real Hotels & Resorts reserves the right of making changes or adjustments to this Policy. If we make modifications or adjustments to this Policy, we will notify you when using the Services or by any of the means of contact indicated by the Affiliate to receive communications from Real Hotels & Resorts.
